Analysis
President Joe Biden and his administration are planning to propose radical changes to the U.S. Supreme Court, including term limits for longest-serving justices and an enforceable code of ethics, according to media reports.
Chief among the changes Biden plans is to publicly back eliminating lifetime appointments and an ethics code for the court containing an enforcement mechanism that detractors say could be used to target conservatives and moderates.
The move to fundamentally change the third branch of government is seen by political observers as an attack by politicians and radical groups determined to grab power through any means necessary.
Kelly Shackelford, president, CEO, and chief counsel of First Liberty, criticized Biden’s proposal as an attempt to alter the Supreme Court for partisan reasons. He said it would destroy the independence of the judiciary and threaten the civil liberties of all Americans.
“Joe Biden once said that changing the structure of the Court was ‘a bonehead idea’ that would ‘put in question the independence of the Supreme Court,’” said Shackelford. “The last thing we need in this country right now is a Supreme Court Coup that would threaten judicial independence and our democratic republic. This is a radical attempt by a desperate politician.”

As recently as 2020, Biden spoke against calls to reform the court during the Democratic primary, saying that adding or subtracting justices would ruin its credibility. But like many of his flip-flops, all that has changed now.
CNN reported that Biden’s move would be popular among progressives in the Democratic Party who have been pushing court reform for years.
Perhaps Biden’s suggested changes to the high court come as he comes under growing pressure to step aside in his bid for a second term in the White House. It is just another one of Biden’s unpopular proposals.
Polling has revealed that 72% of Americans believe that the politicization of the Supreme Court threatens judicial independence, 69% do not want Congress taking over and setting rules for judicial ethics, and 68% oppose court-packing or expanding the size of the Court. More Americans need to know the threat this scheme poses and work together to save the priceless heritage of the U.S. Supreme Court.
Like many of the unpopular actions of Biden’s presidency, his extreme proposals appear to be designed to destroy the legitimacy of the Supreme Court – the very people who are sworn to uphold the Constitution and the rule of law.
